Terms & Conditions for the Free Pilot Project
1. The Free Pilot Project
The Free Pilot Project (hereinafter, the «Pilot») is a free of charge provision of Customer Experience services, as defined below, provided by INNOLOGY VENTURES, S.L. («INNOLOGY», «we», «us» or «our») to the winner of the draw («winner», «Customer», «you», «your») where a Free Pilot Project has been offered. Hereinafter, INNOLOGY and Customer shall be referred to individually as the “Party” and collectively as the “Parties”.
By participating in the Free Pilot Project draw and submitting your email, you agree to these Terms & Conditions for the Free Pilot Project, to our General Terms of Use (https://web.opinator.com/terms-of-use/) and you confirm that you have read and accepted our Privacy Policy (https://web.opinator.com/privacy-policy/). Your information will be used to communicate with you about this promotion and to share relevant updates about our products and services. For any matters regarding your personal data or our privacy policy, you may contact us by email at legal@opinator.com. Your data is stored securely and treated with care in accordance with the applicable laws and regulations.
2. Pilot winner selection
Within 5 working days from the end of the event where the Free Pilot Project has been offered, a winner will be chosen at random from all participants using a random selection tool. The winner will be notified by email and must claim the Pilot by responding to the email within 48 hours of receipt of the notification. If the winner’s email address is incorrect and/or does not allow email delivery, or if the Pilot is not claimed within the established time frame, we reserve the right to choose another winner or to cancel the draw.
3. Requirements
The Pilot program will only be carried out by us upon signing of our general service agreement (hereinafter, the «Agreement») and the corresponding annexes that may be necessary (including a data processing agreement), which sufficiently cover the legal requirements for the provision of services corresponding to the Pilot. These legal documents will be drafted by us and must be accepted and signed by the winner, or by the entity represented by the winner. It will be understood that the entity represented by the winner is the one corresponding to the professional and/or corporate email domain used by the winner for the draw. If the Agreement is not signed by the Parties within 30 days from the claim of the Pilot, we reserve the right to choose another winner or to cancel the draw.
The Pilot will only be developed in countries where we can currently develop the services included in the Pilot.
4. Customer Experience services included in the Pilot
The Pilot will have a limited duration of up to three (3) months (the «Duration»), starting from the date when the Agreement is signed by both Parties («Effective Date»).
During the Pilot Duration, Customer will receive the following services and feaures of our OPINATOR platform:
- OPINATOR Core Service: Access to our core service for a period of three (3) months.
- Fully Customized Feedback Experiences (OPIs): OPIs must be customized by Customer.
- Real-Time Decisioning Engine: this must be customized by Customer.
- Fully Customized Dashboard: this must be customized by Customer.
- Survey Responses: Up to 100,000 completed surveys.
- Dashboard Viewers: Up to 100 dasboards viewers.
5. Services not Included in the Pilot
The following services and features are not included in the Pilot:
- Professional Services: Any professional services, such as customizations, implementation, integrations, or custom development are not included in the Pilot.
- Advanced Modules: Modules such as Text Analytics, AI Insights, Unsolicited Feedback Collection, Case Management, and Close the Loop are not included in the Pilot.
- Any service of feature not explicitly stated as included in the Pilot.
6. Other considerations
- The Free Pilot is valid only for the above stated Duration. After the Duration, the Pilot’s services will be discontinued, without penalty or need for cause, unless otherwise agreed between the Parties, expressly and in writing.
- We reserve the right to modify, extend, or terminate the Pilot and/or any of its services and/or features at any time, without penalty or need for cause, with five (5) days’ notice.
- This Pilot is free of charge and for evaluation purposes only, and does not constitute a commitment for Customer to purchase any services.
These Terms & Conditions for the Free Pilot Project shall be governed and construed under the laws of Spain, without regard to its choice of law provisions. The Parties hereby irrevocably consent to exclusive jurisdiction and venue in the state and federal courts located in Madrid, Spain for any action, suit, or proceeding in connection with this these Terms & Conditions for the Free Pilot Project and hereby waive any defense based upon improper or inconvenient venue or lack of personal jurisdiction.
